1. Acceptance of these Terms

By using our website or buying anything from us, you agree to these Terms. If you do not agree, please do not use the site or make a purchase. You must be at least 18 years old, or the age of majority where you live, to make a purchase. If you buy on behalf of an organization, you confirm that you are authorized to accept these Terms for it.

2. Purchases and pricing

All prices on our website are listed in US dollars (USD). Prices do not include shipping, which is shown at checkout for print orders, and any applicable taxes, which may be added at checkout depending on your location. Payments are processed securely by Stripe; by completing a purchase you also agree to provide accurate payment and contact information.

We may change prices at any time, but a price change will not affect an order you have already placed. If a product is listed at an incorrect price because of an error, we may cancel the order and refund you in full. Your order is accepted when you receive a confirmation email from us or Stripe.

3. Digital products

Digital products include eBooks, digital magazine issues, toolkits, templates and similar downloadable or online materials. When you buy a digital product, we grant you a personal, non-exclusive, non-transferable license to download, view and use it:

• for personal use, if you buy as an individual; or
• for internal use within your organization, if you buy toolkits or templates for work (for example, using a template with your own team).

You may not resell, redistribute, publicly share, upload to file-sharing services or sublicense digital products, or remove any copyright notices, unless we agree in writing. Team, classroom and enterprise-wide use requires a separate license; please contact us.

4. Print products and shipping

Print products include paperbacks, hardcovers and the magazine print add-on. We currently ship print orders to the United States, Canada, the United Kingdom and Australia. Shipping costs and estimated delivery times are shown at checkout before you pay.

Delivery estimates are not guaranteed, and we are not responsible for delays caused by carriers, customs or events outside our control. Orders shipped outside the United States may be subject to import duties, taxes or customs fees, which are the recipient's responsibility. Please check your shipping address carefully at checkout; we cannot be responsible for orders sent to an address you entered incorrectly.

5. Subscriptions and memberships

Subscriptions include ScaledLearning Magazine (monthly or annual), memberships (Member and Pro Learner, monthly or annual). Subscriptions renew automatically at the end of each billing period (monthly or yearly) at the then-current price, and your payment method will be charged unless you cancel.

You can cancel any time. Cancellation takes effect at the end of your current billing period, and you keep access until then. We do not provide partial refunds for unused time in a billing period, except where required by law. If we change a subscription price, we will tell you in advance, and the new price will apply from your next renewal.

6. Refunds

Digital products are non-refundable once they have been delivered or made available to you, except where required by law.

Print products: if an item arrives damaged or you receive the wrong item, contact us within 30 days of delivery with your order details and, where possible, a photo. We will send a replacement or issue a refund.

Nothing in these Terms limits any rights you have under consumer protection laws that cannot be excluded.

7. Cohort programs and enterprise services

Role-based cohort programs, coaching, workshops, content licensing, AI learning agent pilots and other enterprise services are provided under a separate agreement or order form. If that agreement conflicts with these Terms, the separate agreement controls for those services.

8. Intellectual property

All content on scaledlearning.com and in our products, including books, magazine issues, toolkits, text, illustrations, designs, logos and the ScaledLearning name, is owned by ScaledLearning or its licensors and is protected by copyright, trademark and other laws. Except for the licenses described in these Terms, nothing gives you any right to use our content or trademarks. You may quote short excerpts with attribution for commentary or review.

9. Acceptable use

When using our website and services, you agree not to:

• break any law or infringe anyone's rights;
• copy, scrape, resell or redistribute our content or products except as allowed by these Terms;
• attempt to gain unauthorized access to our systems, interfere with the site or introduce malware;
• use our content or products to train artificial intelligence models without our written permission; or
• harass, abuse or harm other members, or post unlawful or misleading content in any community space we provide.

We may suspend or end access for anyone who breaks these rules.

10. Disclaimers

Our books, magazine, toolkits, courses and other materials are provided for educational and informational purposes. They are not legal, financial or other professional advice, and results will vary from person to person and organization to organization. Except as expressly stated in these Terms, the website and our products are provided "as is" and "as available", without warranties of any kind, to the fullest extent permitted by law.

11. Limitation of liability

To the fullest extent permitted by law, ScaledLearning will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or business, arising from your use of the website or our products. Our total liability for any claim relating to these Terms or our products is limited to the amount you paid us for the product or service giving rise to the claim in the 12 months before the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

12. Governing law

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law rules. Any dispute arising from these Terms or your use of our website or products will be handled in the state or federal courts located in Texas, and you consent to their jurisdiction, except where the law of your country of residence gives you the right to bring a claim in your local courts.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top of this page. Changes apply to purchases made after they are posted; the Terms in effect at the time of your purchase apply to that purchase. Continuing to use the site after changes are posted means you accept the updated Terms.
